Governance and Development Advocates Commend President Hakainde Hichilema for Dismissing Constitutional Court Judges

Governance and Development Advocates Zambia has praised President Hakainde Hichilema for his decision to dismiss three Constitutional Court judges, affirming that this action aligns with the provisions of the Zambian Constitution and the country’s legal framework.

Elias Mulenga, the Executive Director of Governance and Development Advocates, expressed his support for the President’s decision, emphasizing its appropriateness given the circumstances. Mulenga stated, “The dismissal of the judges is the right course of action to take as provided by the Constitution and the laws of Zambia.”

He highlighted the organization’s concern over certain narratives circulating on social media, suggesting that President Hichilema’s decision was arbitrary. Mulenga clarified that the dismissal followed a formal complaint against the judges, which was thoroughly investigated by the Judicial Complaints Commission (JCC).

According to Mulenga, the JCC conducted a comprehensive inquiry and subsequently made recommendations to President Hichilema, who acted upon these recommendations in accordance with the established legal procedures outlined in the Constitution of Zambia. “The JCC’s findings were taken seriously, and the President has adhered to the procedures enshrined in our legal framework,” he added.

The Executive Director further stressed that the President’s actions are grounded in his constitutional mandate, which is clearly delineated in the Zambian Constitution. He pointed out that President Hichilema had no alternative but to invoke and exercise the powers vested in him under Article 143 (b) and (c), which relate to the appointment and dismissal of judges, thereby fulfilling his oath of allegiance to uphold the Constitution.

Mulenga also underscored President Hichilema’s commitment to constitutional governance and urged citizens to refrain from criticizing the President in the execution of his duties. “It is crucial for the public to understand that the President is a respecter of the Constitution and the laws of Zambia. Criticism should be constructive and rooted in an understanding of our legal processes,” he stated.
